Portico Terms of Use & Privacy Policy
Portico is a software platform designed to help HOAs and residential communities manage communication, payments, and amenity reservations with ease. By accessing or using our website, mobile app, or services (collectively, the "Service"), you agree to comply with and be bound by the following Terms of Use and Privacy Policy.
1. Definitions
"Portico," "we," "our," or "us" refers to the creators and operators of the Portico software platform.
"You" or "User" refers to any individual or entity using the Service.
"Service" means all websites, apps, software, content, and features provided by Portico.
"Community" means a group of units managed by an HOA, property manager, or board of directors using Portico.
"Resident" means any user assigned to a specific unit in a community.
"Admin" means any user with elevated privileges for managing a community's settings, users, or content.
2. Acceptance of Terms
By accessing or using Portico, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree with any part of these terms, you may not use the Service.
These Terms constitute a legally binding agreement between you and Portico. You are responsible for reviewing and understanding these Terms periodically. Continued use of the Service after any updates constitutes acceptance.
3. Use of the Service
You agree to use the Service only for its intended purposes, which include managing HOA communications, payments, amenities, and administrative workflows. You are solely responsible for any activity conducted under your account.
You may not:
Use the Service for any fraudulent or unlawful purpose
Disrupt, interfere with, or harm the integrity or performance of the Service
Use automated systems (bots, crawlers, etc.) to access the Service without prior written consent
Reverse-engineer or attempt to extract source code from the platform
4. Account Registration
To use Portico's full functionality, you must register for an account and provide complete and accurate information. You agree not to:
Share your login credentials with others
Create more than one account per person or impersonate another individual or entity
Portico may suspend or terminate your account if we suspect inaccurate or fraudulent account information.
Admins are responsible for managing access and permissions within their own communities. If you're assigned to a unit by a third party (e.g., a building manager), that party may control certain aspects of your account.
5. Payments and Billing
Portico offers tiered subscription plans. Payment is due in advance for each billing period. Prices are listed on our Pricing Page and are subject to change with advance notice.
All payments are securely processed via Stripe or another third-party payment processor. We do not store full payment card data.
You are responsible for:
Maintaining accurate billing information
Paying any transaction or convenience fees, if applicable
Cancelling your subscription if you no longer wish to use the Service
If your payment method fails or your account becomes delinquent, we may suspend or terminate your access.
6. Privacy and Data Use
We are committed to protecting your privacy. Data collected through the Service includes:
Registration info (name, email, unit number, etc.)
Payment history and preferences
Messages, bookings, documents, and support interactions
Usage analytics (device type, activity timestamps, etc.)
We use this data to:
Provide the Service and improve functionality
Respond to user inquiries and provide support
Analyze engagement for feature development and product enhancements
Comply with legal obligations and protect Portico and our users from harm
We will never sell your data. We only share data with third-party vendors that help us operate the platform and are contractually bound to respect your privacy.
You may request:
Access to your data
Correction of inaccuracies
Permanent deletion of your account and associated personal data (subject to legal retention requirements)
7. Prohibited Activities
You may not use Portico to:
Harass, threaten, or defame individuals or entities
Post hate speech, discriminatory content, or obscene materials
Upload viruses, malware, or attempt to exploit system vulnerabilities
Circumvent or breach any security or authentication measures
Use Portico for advertising, spam, or solicitation unrelated to your community
Violations of this section may result in immediate suspension or termination of access without refund.
8. Termination
We reserve the right to suspend or terminate your access at any time, with or without cause. Reasons may include:
Breach of these Terms
Legal obligations
User inactivity over extended periods
Upon termination:
Your account and access to the Service will be disabled
You may lose access to data, messages, and records stored in Portico
We may retain data as required by law or to resolve disputes
9. Intellectual Property
All content and code within Portico (including design elements, logos, product names, and underlying software) are owned by Portico or its licensors.
You may not:
Reproduce, modify, distribute, or use our IP without written permission
Use Portico branding in a way that implies affiliation without consent
You retain ownership of any content you post or upload to Portico (e.g., community guidelines, documents), but you grant Portico a license to store, display, and use it as part of providing the Service.
10. Disclaimers
The Service is provided on an "as is" and "as available" basis. We disclaim all warranties, including:
That the Service will be uninterrupted or error-free
That the data within Portico is always up-to-date or accurate
That the Service will be free of viruses or harmful components
You use Portico at your own risk. We are not responsible for actions taken by community managers, residents, or other users.
11. Limitation of Liability
To the fullest extent permitted by law, Portico and its team are not liable for any indirect, incidental, consequential, or punitive damages, including:
Lost data
Lost revenue or profits
Inability to access the Service
Disputes between users or communities
If we are found liable for any reason, our total liability is limited to the amount paid by you to us in the 6 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Portico, its employees, officers, and partners against any claims, damages, liabilities, and costs arising from:
Your use of the Service
Your content or conduct on the platform
Your breach of these Terms or applicable laws
13. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be brought in the courts of Travis County, Texas.
You agree to waive any class action claims and resolve disputes on an individual basis.
14. Changes to Terms
We may revise these Terms at any time. Updates will be posted to the website and the "Effective Date" will be revised accordingly.
If material changes are made, we may notify you via email or in-app message. Your continued use of the Service after changes become effective indicates your agreement.
15. Children's Privacy
Portico is not intended for children under 13. We do not knowingly collect data from children, and accounts found to be created by or for children may be removed.
If you believe a child has provided us personal data, contact us so we can delete the information.
